Terms and conditions
By using this website (www.thehairversity.com), you are agreeing with the following terms and conditions of use. These terms and conditions will apply to all quotations, offers, orders, agreements and deliveries of services or products on behalf of The Hairversity. Please read these terms and conditions carefully. If you do not agree to these terms and conditions, you should not use this website. You acknowledge that The Hairversity may update the terms of conditions when necessary.
Definitions
- The Hairversity: the Hairversity, established in Amsterdam, Chamber of Commerce no: 81769989
- Customer: the person with whom the Hairversity has entered into an agreement
- Parties: the Hairversity and customer together.
- Product: hair.
Prices
- All prices used by The Hairversity are in Euros, are inclusive of VAT and exclusive of any other costs such as administration costs, levies and travel-, shipping- or transport expenses, unless expressly stated otherwise or agreed otherwise. The price in Euros can be converted to a number of different currencies including, United States Dollar, Pond Sterling, Canadian Dollar and Australian Dollar. We try to ensure that all prices quoted are accurate.
- The Hairversity is entitled to adjust all prices for its products or services, shown in its shop, on its website or otherwise, at any time.
- The cost of products and services may increase, and all prices advertised are subject to such changes.
Delivery
- Delivery takes place while stocks last.
- Delivery of products ordered online takes place at the address indicted by the customer.
- Any delivery period specified by The Hairversity is indicative and does not give the customer the right to dissolution or compensation if this period is not met with, unless the parties have expressly agreed otherwise in writing.
- The processing starts on the next business day once the customer has fully completed the (electronic) ordering process, received an (electronic) confirmation of his order from The Hairversity.
- Exceeding the specified delivery period does not entitle the customer to compensation or the right to terminate the contract, unless The Hairversity cannot deliver with 30 days or if the parties have agreed upon otherwise.
- The customer must ensure that the actual delivery of the products ordered by him can take place in time.
Packaging, processing and shipping
- Shipping costs are on behalf of the customer, unless the parties have agreed otherwise.
- If the package of a delivered product is opened or damaged, the customer must have a note drawn up by the forwarder or delivery person before receiving the product. In the absence of which The Hairversity may not be held accountable for any damage.
- Processing time is 5-12 business days (depending on your order), this also includes sale orders. If the payment was done with a creditcard please add 5 business days to your product for processing. Standard shipping in The Netherlands are 3-6 business days. International shipping: 10-15 business days (depending on the country).
- We only ship out orders Monday through Friday business hours (10:00 – 17:00 PM - CET). Please keep in mind holidays do not count as a business day and should be considered when calculating shipping times.
Guarantee
- The risk of loss, damage or theft of the products that are the subject of an agreement between the parties, will pass on to the customer when these products are legally and/or factually delivered, at least are in the power of the customer or of a third party who receives the product for the benefit of the customer.
Exchange/returns
- Exchange or returns are not possible. Due to the federal health regulations all sales are final. Unless there is a mistake made on behalf of The Hairversity. We will immediately make the change to correct it.
- If there is a mistake made on behalf of the Hairversity notify within 2 days after receiving your product. The following conditions must be met:
- Return must take place within 2 days after the notification upon presentation of the original invoice.
- The product is returned in the original packaging and the original tags/wraps still attached to it.
- The product has not been used, meaning: no dye, chemicals, alterations, washing, combing, brushing, unraveled etc.
- If all of these conditions are not met the product cannot be exchanged.
- The Hairversity does not offer return shipping labels. The shipping costs for return of the products are at the expense of the customer.
Liability of The Hairversity
- All packages require a signature confirmation on delivery. Once a package leaves our warehouse, the Hairversity are is not responsible for lost or stolen good. The customer will have to open a claim with the shipping company. No refunds or replacements will be sent out until further hearing from the shipping company.
- The Hairversity is not liable for indirect damages, such as consequential loss, lost profit, lost savings or damage to third parties.
- All images, photos, colors, drawings, descriptions on the website or in a catalog are only indicative and are only approximate and cannot lead to any compensation and/or (partial) dissolution of the agreement and/or suspension of any obligation.
Force Majeure
- In addition to the provisions of article 6:75 Dutch Civil Code, a shortcoming of the Hairversity in the fulfillment of any obligation to the customer cannot be attributed to the Hairversity in any situation independent of the will of the Hairversity, when the fulfillment of its obligations towards the customer is prevented in whole or in part or when the fulfillment of its obligations cannot reasonably be required from the Hairversity.
- The force majeure situation referred to in paragraph 1 is also applicable – but not limited to: state of emergency (such as civil war, insurrection, riots, natural disasters, pandemics etc.); defaults and force majeure of suppliers, delivery men or other third parties; unexpected disturbances of power, electricity, internet, computer or telecoms; computer viruses, strikes, government measures, unforeseen transport problems, bad weather conditions and work stoppages.
- If a situation of force majeure occurs as a result which the Hairversity cannot fulfill one or more obligations towards the customer, these obligations will be suspended until the Hairversity can comply with it.
- The Hairversity does not owe any (damage) compensation in a situation of force majeure, even if it has obtained any advantages as a result of the force majeure situation.
Change in the terms and conditions
- The Hairversity is entitled to amend or supplement these terms and conditions.
- Changes of minor importance can be made at any time.
- Major changes in content will be discussed by the Hairversity with the customer in advance as much as possible.
Privacy
- The Hairversity guarantees to protect your privacy and promises only to use information collected about you in accordance with the AVG. the European privacy law. We vow not to collect personal sensitive material without your consent. When placing your order, you may submit personal data to the Hairversity. This information will be kept confidentially and securely and will only be used for the agreed purposes of processing your order and fraud prevention.
Applicable law and competent court
- Dutch law is exclusively applicable to all agreements between parties.
- The Dutch court in the district where the Hairversity is established is exclusively competent in case of any disputes between parties, unless the law prescribers otherwise.
